įstatymo viršenybė statusas T sritis Politika apibrėžtis Konstitucionalizmo principas, kad valstybės valdžią įgyvendinančios institucijos privalo paklusti teisei ir nepažeisti jos nustatytų veikimo ribų. Termino ištakos – Platono, Aristotelio idėjos apie įstatymo galią riboti valdančiųjų savivalę. Šiuo metu principas įtvirtintas daugelio valstybių konstitucijose. Lietuvos Konstitucijos preambulėje įtvirtintas kaip teisinės valstybės siekis. Paprastai siejama su valdžių padalijimo principu ir reikalavimu, kad įstatymų leidžiamoji ir vykdomoji valdžia, priimdama bei įgyvendindama teisės aktus, griežtai laikytųsi jų hierarchijos ir nepažeistų konstitucijos. Viena iš principo garantijų yra teisinės priežiūros institutas. Suponuoja ir žmogaus teisių bei laisvių apsaugą, nes iš šio principo kyla nulla crimen et poena sine lege (įstatymu neuždrausti veiksmai negali būti laikomi nusikalstamais ir dėl jų negali būti skiriamos įstatymų nenumatytos bausmės), A. V. Dicey išryškinti asmenų lygybės prieš įstatymą ir teisingo proceso principai. J. Rawlsas pabrėžė, kad esant aiškiai suformuluotiems įstatymams, įstatymo viršenybė yra asmens laisvės garantas. R. Dworkinas susiejo teisės („įstatymo“) ir teisingumo sąvokas, teigdamas, kad pasitelkus tinkamus principus, galima tinkamai išspręsti net itin sudėtingas bylas, kada įstatymas nėra aiškus.
